Medical Benefits for Pregnant Workers

Every woman employee who has worked for less than 150 days is entitled to a medical leave of 30 days. The leave would be accompanied by a payment. The maternity leave is awarded with full pay if she has at least 80 days in an establishment in the year before her expected delivery.

The maternity benefit is given at the rate of the average daily wage for the period of a worker's actual absence from work. A female worker is entitled to a medical bonus of 3,500 Indian rupee, apart from 12 weeks of salary. The maternity benefit of at least Rs. 6,000 is available to pregnant women and lactating mothers.

Women who have paid PRSI contributions on their social insurance record and who are insurable employment up to the first day of their maternity leave are eligible for maternity benefit. It is necessary to take at least 2 weeks and not more than 16 weeks of leave before the baby is due. To ensure you take the minimum period of maternity leave before the birth of your baby, you must start your leave on the Monday before the week in which your baby is due.

If your due date is Wednesday 13 October 2021, the latest date for the start of your maternity leave is Monday 4 October 2021. If your child is in the hospital, you can delay the last 12 weeks of maternity leave. You must have taken at least 4 weeks of maternity leave after your baby was born to be eligible for your Maternity Benefit.

How many employers do you need?

Your average pay is worked out over 8 weeks, and is finished 15 weeks before your due date. If you're close to the minimum pay, you should contact Citizens Advice. You can get the full amount of maternity pay from more than one employer.

The rules for each employer are the same as for your only employer. Some jobs give you maternity pay as a benefit. If you get statutory maternity pay, you should never be worse off than if you don't.

The Standard Minimum Working Time (SMP) Rate

Your expected week of childbirth is the week of your due date. It begins on the Sunday before your due date and ends on the Saturday after. If your due date is on a Sunday, your baby's birth will start on the same day.

The reference period is eight weeks from the end of the first week to the end of the second week. Normal earnings are those in the last two pay slips before the end of the week. The last eight pay slips before the end of the week are taken into account.

If you are paid monthly, you must add the two payslips together. You divide by 52 to get a weekly figure. SMP is paid at a rate of 90% of your normal earnings in the first six weeks.

It will be paid at the same rate for the next 33 weeks, either a flat rate or a higher one. If you have enough earnings to get the flat rate, you will be treated as self-employed if you have registered as one. You can either register for self-assessment or make voluntary class 2 NI contributions in order to qualify for the full flat rate.

Maternity Leave and SMP

If you don't plan to go back to work or your job ends after 15 weeks before your baby is due, you can still get SMP. If you don't return to work, you don't have to pay back your SMP. If you want to change the start date of your maternity leave, you must give your employer at least 28 days' notice.

If there is a good reason why that is not possible, tell your employer as soon as possible. You need to give your employer the correct notice to get SMP. If you don't know if you are entitled to SMP, you should give your employer the correct notice and they will work out whether or not you qualify.

If you don't qualify for SMP, they will give you a form to explain why and you should claim maternity allowance. You don't need to work full-time, but you can work part of a week. You can include self-employed work if you want to meet the conditions.

You are considered to be employed in any week in which you have a zero hours contract. 11 weeks before your expected week of birth is when you can be paid MA. You should notify the Jobcentre Plus if you want to start maternity leave before you start your MA1 claim.

MA can be claimed 15 weeks before your baby is due. You should put in your claim form as soon as possible, and notify the Jobcentre Plus of the date you intend to stop working. You can get Maternity Allowance if you have 26 weeks of self-employment before your baby is due.
